In a highly unusual development at the Court of Appeal, three judges presiding over a pensions’ dispute case couldn’t find common ground on a ticklish issue and ended up writing two separate judgements. On account of justice being a numbers game, the tie was broken by a third judge who sided with a colleague who made a controversial ruling that trade unions won’t be too happy about.
